Constitutional Court Announces 8 Directions For Speedy Trial Of Elections Presidential Case
In the ongoing high profile Presidential case, the Constitutional Court has on Tuesday, the eighth day of case, announced 8 directions, which will serve as footpath for speedy case.
The announcement was made by High Court Judge, Justice Healey Potani who is leading the panel of 5 judges that are presiding over the Presidential Elections being heard in the Constitutional Court.
In the first week of the case, lawyers representing the second petitioner in the case, Malawi Congress Party (MCP) President, Lazarus Chakwera, expressed concern over delays encountered in the case chief among them, repetitive questions by Malawi Electral Commission (MEC) lawyers when cross-examining the first petitioner, UTM Party President, Saulos Chilima.
Among the laid out directions are: Laywers will not be allowed to make cross references to other witness statements when cross examining a different witness; No repetition of questions asked by previous lawyers irrespective of parties represented and also that cross- examination should be limited to matters in dispute.
