Court Ruled That Businessperson Ashok Nair Is Free

The High Court in Lilongwe has today ruled in favour of businessperson Ashok Nair stopping Anti-Corruption Bureau(ACB) from re-arresting him or taking him into detention. This follows a judicial review application filed by Nair's lawyer Michael Goba Chipeta that the enforcement of an earlier judgment by the same court on 30th May 2022, be suspended until a determination by the Supreme Court of Appeal on another interpartes application by former Minister of Lands Kezzie Msukwa on stay of judgement is heard. Court Granted Stay Order To Stop ACB Arresting Msukwa

The Supreme Court of Appeal has granted a stay order to former Minister of Lands Kezzie Msukwa, stopping the Anti-Corruption Bureau – ACB from arresting him. The development comes after Msukwa was expected to be taken to court today after the bureau took a statement from him. According to Chimwemwe Kalua, lawyer for Msukwa , the stay order is stopping order is stopping the ACB from investigating, arresting and prosecuting Msukwa based on the information for the National Crime Agency- pending an interparty hearing scheduled on 28 June ,2022. He added that the stay order is also stopping a judgment by High Court Judge Redson Kapindu who dismissed an application by Msukwa and Ashok Nair, who wanted their arrests by the ACB to be annulled.

In the audio, Chizuma is in a conversation with someone where she makes a number of allegations which include that Ashok bribed Judge Simeon Mdeza who released him after bring arrested by ACB. It is well known that Mdeza, feeling affronted, recused himself from the Ashok case. Some have argued that while she made the allegations, the conversation was not meant for public circulation, hence Ashok's lawsuit being an overreaction and bentto frustrate ACB's action on the case for which Ashok was first arrested. DPP Refused To Grant ACB Consent To Prosecute Ashok Due Lack Of Supporting Documents

Director of Public Prosecutions (DPP) Steven Kayuni has refused to grant the Anti-Corruption Bureau (ACB) consent to prosecute Ashok Nair, and four [names withheld] others on grounds of lack of supporting documents. In a letter to the ACB, Kayuni tells the bureau that his office perused though documents that were submitted for the purpose of obtaining consent to prosecute Kumar Sreedharan and four other people over corruption-related matters. The DPP, however, notes that he needs the graft-busting body to furnish his office with a complete report of investigations instead of an interim investigation report to be able to prosecute Nair, who was released on bail by the courts recently. Oops! ACB Director Martha Chizuma Attacks Judiciary, Attorney General

In rather bizarre circumstance, Anti-Corruption Bureau (ACB) Director Martha Chizuma has accused the judiciary of receiving millions from Ashok Nair who was arrested some three weeks ago. Chizuma, who is in a plot to finish off Malawians of Asian origin doing business with the government, made the accusation in a leaked voice call in our custody believed to have been leaked by her close associate.
