High court Judge Justice Kenyata Nyirenda has refused to grant a stay order which the Anti Corruption Bureau applied in a case involving the Anti Corruption Bureau-ACB and former Inspector General of Malawi Police Service George Kainja.
Earlier in the case, the ACB wanted Judge Nyirenda to recuse himself claiming he is an interested party in the case to which Nyirenda refused.
The ACB further applied for a stay order following Nyirenda’s refusal to recuse himself.
The ACB’s application was eyeing an appeal on the judgement.
Reading out his ruling, Judge Nyirenda, refused to grant the stay order saying the ACB did not follow proper procedure when it applied for the stay order.
Commenting the on the development, the Lawyer for Kainja, Ian Nankhuni said this means the case will continue on 15 November as set by the court while the lawyer for ACB Imran Saidi said they will discuss the outcome of the case as a Bureau before deciding on the same.
