The Malawi Communications Regulatory Authority (MACRA) says it will continue to enforce the ‘Cease and Desist Order’ on Globe Internet Limited.
The development follows an injunction sought by Globe Internet Limited preventing MACRA from fully enforcing its regulatory sanctions for its illegal usage of frequencies in the 700MHz band
as communicated in its letter dated 18th July 2022.
In a statement, MACRA says the order as granted by High Court stays enforcement of:
- The payment of a $73,260 fine for illegal usage of spectrum in the 700MHz band;
and - Accounting for revenues made by Globe Internet Limited during the period of
illegal spectrum usage.
However, the Court has refused to restrain MACRA from implementing the cease and desist order on the usage of the frequencies in the 700MHz spectrum band by Globe Internet Limited and surrendering the same to the Authority within 30 days from its decision.
“In line with the Court Order, MACRA shall fully enforce its “cease and desist order” against Globe Internet Limited on using frequencies in the 700MHz.
“MACRA remains committed to enforcing compliance with its legal, regulatory, and
licensing conditions to ensure sanity and uphold the rule of law in the communications sector,” reads the statement in part.
