Kasasile people demands K150 billion compensation for damages

Legal practitioners representing the people of Kasasile in Nkhatabay district have filed a claim to the Honorable Attorney General Thabo Chakaka-Nyirenda demanding 150 billion Malawi Kwacha for damages.

The damages include false imprisonment, malicious prosecution, assault and buttery, pain and suffering, loss of use of land, loss of business, breach of right to economic activity and legitimate expectation.

The claim has been filed by two Kasasile citizens Joshua Ngugi Msiska and Buleya Msowoya on behalf of themselves and on behalf of 1172 people of Kasasile against the Attorney General for the trauma they are suffering till today.

In the claim dated 5th May, 2025 the Lawyers have claimed that they are informed by their Clients that the Malawi Defense Force (MDF) soldiers unlawfully and wrongfully evicted people of Kasasile from their leasehold lands, their rightful use and occupation of the land on the basis of the Map provided by the Ministry of Lands and retracement of beacons.

The Lawyers say their Clients were arrested, tried but the court acquitted them for the offenses alleged to have been committed saying the soldiers also burnt down houses, seized and destroyed their crops and farm inputs and machinery and rendered their investments useless and exercised their military antics on these Kasasile defenseless people.

“We serious condemn such acts!!!! They are uncalled for and not in line with the country’s Constitution,” reads the claim in part.

The Court in Mzuzu ruled in favor of the people of Kasasile that the land from which they were forcefully evicted by the MDF soldiers was their customary land ordering Kasasile people to assess the damages caused and acquitted all those that were wrongly imprisoned at Mzuzu prison.

In one of the previous audio clips, Political activist Bon Kalindo appealed to well-wishing lawyers to come to the knees of the people of Kasasile to file claim for damages to the High Court of Malawi for government to compensate the people following the court judgement.

Speaking in Mzuzu, Bishop Martin Mtumbuka of the Diocese of Karonga in the Roman Catholic Church condemned the MDF Soldiers in front of their Commander in Chief President Dr. Lazarus Chakwera for the act of cruel on the lives of innocent people of Kasasile.

Bishop Mtumbuka reminded the soldiers that Malawi is not ruled by a military junta saying no one in this country including President Chakwera is above the law advising them that if they are strong enough, they should go to Goma in the DRC to meet M23 rebels to test their power.
