Students from Lilongwe University of Agriculture and Natural Resources (LUANAR) NRC campus have called on Chief Justice Rizine Mzikamanda to intervene in a legal dispute between their university and Fargo Limited. The students allege that an injunction granted by Justice Ken Manda is hindering their right to education by stalling a critical construction project on campus.
In a letter addressed to the Chief Justice, signed by the Students Representative Council (SRC) President Overton Jere, the students expressed their frustration over the stalled construction of a teaching complex. According to the letter, LUANAR had awarded Fargo Limited a contract for the project, and despite receiving partial payment, the company failed to meet its contractual obligations. As a result, LUANAR terminated the agreement and sought to recover the funds.

However, Fargo Limited took the matter to court, where Justice Ken Manda granted an ex parte injunction in favor of the company. This injunction has prevented LUANAR from accessing the funds needed to complete the construction project, effectively halting progress on the much-needed teaching complex.
The students argue that the injunction has negatively affected their education by delaying the completion of the teaching complex, which is essential for accommodating the growing number of students and providing an optimal learning environment. They see the delay in justice as an infringement on their right to education.

The SRC, representing the interests of the students, has given the judiciary a seven-day ultimatum to vacate the injunction, allowing LUANAR to access the funds and resume construction. Additionally, they have called for Judge Ken Manda to be removed from the case, citing concerns over his handling of the matter.
In their letter, the students emphasized the urgency of the situation, asking the Chief Justice to ensure that justice is delivered promptly. They expressed concern that further delays could continue to disrupt their education and worsen the learning conditions at LUANAR’s NRC campus.
The case between LUANAR and Fargo Limited is critical not only for the university’s infrastructure development but also for the students’ ability to access quality education. The students hope that Chief Justice Rizine Mzikamanda’s intervention will lead to a swift resolution of the case and that the teaching complex project can be resumed without further delays.
