MEC Chair Justice Mtalimanja, NRB Principal Secretary Mphatso Sambo face arrest over contempt of court

The High Court of Malawi in Blantyre is set to begin a crucial hearing today regarding an application to commit Malawi Electoral Commission (MEC) Chairperson Justice Annabel Mtalimanja, National Registration Bureau (NRB) Principal Secretary Mphatso Sambo, and three others for contempt of court.

The case, brought forward by George Chipwayila and four other residents of Kachere, alleges blatant disregard of a court order by the accused. The High Court had previously directed the MEC and NRB to conduct side-by-side registration of citizens and voters, a directive that the claimants argue has been ignored.

The claimants argue that the court’s order was clear and binding, requiring immediate action from the Electoral Commission and the Bureau to facilitate the dual registration process. They allege that failure to adhere to the directive is an act of contempt and a deliberate obstruction of justice.

The hearing is scheduled to commence at 2:30 PM at the High Court Principal Registry in Blantyre. This legal battle could have significant implications, as contempt of court charges carry severe penalties, including potential arrest and imprisonment for those found guilty.

Observers note that this case could test the accountability of public institutions in upholding the rule of law, particularly as Malawi gears up for the 2025 general elections.
