Lilongwe, Malawi – The High Court has directed the Malawi Electoral Commission (MEC) to release the long-awaited results for the Lilongwe Mtandire–Ntsiriza parliamentary election. The ruling follows an application by Democratic Progressive Party (DPP) candidate and Minister of Homeland Security, Alfred Gangata, who argued that the commission was unjustifiably withholding the final tally.
The case was presided over by Judge Simeon Mdeza, who emphasized that MEC should rely on original tally sheets submitted from polling centers in the constituency. The election was tightly contested between Alfred Gangata (DPP) and former legislator George Zulu (MCP).
Background to the Dispute
Following the election, Alfred Gangata requested the court to compel MEC to release the results, asserting that the tally sheets clearly showed he had won the parliamentary seat. He insisted that no grounds existed for a re-run or vote nullification.
On the other hand, George Zulu of the Malawi Congress Party (MCP) had written MEC requesting the results be withheld, alleging that the electoral process contained irregularities that affected the integrity of the outcome.
This disagreement resulted in a legal standoff, causing delays in declaring the MP-elect for the constituency.
Court Ruling
In his determination, Judge Simeon Mdeza stated that:
MEC must use the submitted official tally sheets
No new election should be conducted
The commission should proceed to announce the rightful winner
This effectively aligns with Gangata’s request and reinforces the credibility of the recorded vote count.
Reactions to the Judgment
Alfred Gangata and his legal team, led by lawyer Zwelithini Chipembere, have welcomed the ruling, describing it as a victory for transparency and respect for democratic processes.
“We are satisfied that the court has upheld the legitimacy of the original vote count. This brings clarity and fairness to the electoral process,” Chipembere said.
Meanwhile, George Zulu’s lawyer, Pempho Likongwe, expressed dissatisfaction with the ruling, stating that they will consult further before deciding on the next steps, including the possibility of an appeal.
What Happens Next?
MEC is now expected to:
- Compile the confirmed constituency tally results
- Officially announce the winner
- Update parliamentary representation records
Political analysts say the development underscores the importance of legal oversight in electoral disputes and demonstrates the power of the judiciary in safeguarding democratic outcomes.
Conclusion
The High Court’s ruling brings significant progress in one of Malawi’s most closely contested parliamentary races. As stakeholders await MEC’s final announcement, attention remains focused on whether George Zulu will pursue further legal action or accept the court’s directive.
It’s heartening to see the court uphold transparency and push for the release of the results. Hope the MEC follows through quickly and everyone feels heard.
