The committee’s findings follow separate meetings held on Friday with the boards of the two institutions to assess concerns surrounding the appointments.

PAC Vice Chairperson Joshua Malango confirmed that the committee found no legal irregularities in the recruitment processes that led to the appointments.

“I can confirm that we met the two Boards separately and found nothing wrong with the appointments. What the Communications Act says is that the Board shall appoint; it does not specify how that should be done. Again, the Act is silent on qualifications. The clarification comes amid public debate and scrutiny over the appointment processes at the two key communications institutions.

According to PAC, the current legal framework governing appointments under the Communications Act grants boards the authority to appoint Director Generals but does not provide detailed procedures on how such appointments should be conducted. Malango indicated that Parliament may consider reviewing the legislation to provide clearer guidance on appointment procedures and qualification requirements in the future.

The decision is expected to bring certainty to the leadership of both Malawi Broadcasting Corporation and Malawi Communications Regulatory Authority, with Banda and Nkoloma now cleared to continue serving in their respective roles without legal questions hanging over their appointments.
