High Court Grants Relief to 800 Mega Farmers in MAIIC Loan Dispute

The High Court in Lilongwe has granted an injunction restraining the Malawi Agricultural and Industrial Investment Corporation (MAIIC) from enforcing the repayment of loans issued to about 800 beneficiaries under the Mega Farms Loan Programme.

The court order, issued on Friday, prevents MAIIC from compelling the farmers to repay the loans, visiting their farms for enforcement purposes, or seizing their property over alleged loan defaults until the matter is resolved.

Speaking to Capital FM, Mega Farmers Union President Vasco Madhlopa described the injunction as a significant relief, saying it has brought “freedom and peace” to hundreds of farmers who have been under pressure due to loan recovery efforts.

“This relief means freedom and peace for the farmers because the conduct of MAIIC officials has not been appropriate, and it has placed farmers under immense pressure and stress,” Madhlopa said.

According to Madhlopa, MAIIC allegedly breached the terms of the agreement with farmers from the outset, prompting beneficiaries to seek legal intervention.

“Many people are not aware that MAIIC breached the contract from the very beginning. The farmers are therefore seeking justice so that these issues are addressed before any further pressure is applied. However, all the farmers remain ready and committed to repaying the loans once the outstanding issues have been resolved,” he added.

The case is expected to determine whether MAIIC fulfilled its contractual obligations under the government-backed Mega Farms Loan Programme and what impact, if any, that will have on the repayment obligations of the beneficiaries.
