The Malawi Human Rights Commission (MHRC) has announced it will conduct a public inquiry into the accessibility and accountability of the country’s judicial system, aiming to address growing concerns about justice delivery and the affordability of legal services in Malawi.
In a statement released by MHRC Commissioner Chikondi Chijozi, the Commission acknowledged the increasing demand for judicial accountability and emphasized the judiciary’s critical role in interpreting and enforcing the Constitution. Chijozi explained that the inquiry seeks to identify obstacles that limit access to justice, particularly focusing on the high costs associated with securing legal representation and the barriers these present for Malawians seeking fair treatment and resolution through the courts.
The scope of the inquiry will address several key issues, including the financial strain on individuals who require legal assistance, the quality of justice impacted by these costs, and the effectiveness of the judiciary in fulfilling its constitutional mandate. These challenges have contributed to concerns among Malawians about whether the legal system is meeting their needs or perpetuating inequalities.
Commissioner Chijozi emphasized that the MHRC is encouraging members of the public, as well as organizations interested in justice and human rights, to share their experiences and observations. This feedback will inform the inquiry and contribute to identifying areas where reforms may be necessary to improve judicial accountability and accessibility.
The MHRC’s decision to launch this inquiry marks a significant step toward addressing structural issues within Malawi’s judicial system, with the goal of ensuring that all Malawians can exercise their right to justice without financial or procedural barriers.
