Malawi Law Society Speaks Out on Allegations Against Justice Kenan Manda

By Burnett Munthali

The Malawi Law Society (MLS) has broken its silence on the mounting allegations of maladministration of justice against Justice Kenan Manda. In a public statement co-signed by MLS Chairperson Patrick Mpaka, the society addressed concerns raised by private practice lawyer Alexious Kamangila regarding Justice Manda’s conduct in a court case involving Mukeshwar Sugar Mills Limited and Salima Sugar Company Limited.Concerns Raised Over Delayed Investigation into Justice Kenan Manda’s Allegations

The statement revealed that in April 2024, the society formally wrote to the Chief Justice, flagging allegations of misconduct leveled against Justice Manda. These allegations stem from claims of judicial impropriety in the handling of the commercial case between the two companies, which has garnered attention from both the legal fraternity and the public.

The MLS has now urged the Judicial Service Commission (JSC) to act swiftly and transparently in addressing the concerns raised. “We call on the JSC to handle these allegations with the urgency and openness they demand, as public trust in the judiciary is at stake,” the statement read.

Furthermore, the society has called for immediate legislative action, emphasizing the need to expedite the passing of Judicial Reform Bills. These bills, the MLS argues, would establish clearer accountability mechanisms for judges, ensuring greater transparency and integrity within the judiciary.

The society’s stance highlights the importance of reforms aimed at strengthening the rule of law and public confidence in Malawi’s judicial system.
