The Malawi Congress Party (MCP) has become the first political party in Malawi to expose loopholes in the Malawi constitution that its members suspected of committing various offences ranging from terrorizing and hacking innocent people, abuse of office and corruption, are now be declared to be above the constitution

The MCP has proved to Malawians that the country has no rule of law and if it has, it is just on paper to please the donors, MCP members cannot be arrested by the law as they are above the Republican Constitution.
It has never happened in Malawi from before that public officers obtaining court injunctions to stop government from redeploying them to other institutions, MCP has proved it all that injunctions are the order of the day.

First, it was President Dr. Lazarus Chakwera who obtained an injunction stopping the police from searching his house for German shepherd dogs and this was followed by former Army Generals and Police Commissioners
stopping Government from redeploying them to other security institutions.

As this was not enough, the court granted an injunction to MCP panga wielding thugs and Richard Chimwendo Banda stopping the police for re – arresting them, former Minister of Finance Simplex Chithyola Banda obtained his injunction stopping the police from searching his farm in Kasungu.
Former Secretary to the President and Cabinet (SPC) Colleen Zamba was granted her injunction stopping the police from arresting her only by way of court summons and Chithyola Banda’s Warrant of Arrest has been cancelled only by way of court summons too.
A Malawi Congress Party (MCP) diehard of Mvera in Dowa district Mr. Rodgers Kamphangala, has called on the authorities in Malawi to call for a Constitutional conference to revisit, review and amend the Republican Constitution.
Kamphangala said the Malawi Constitution as it is today, is favouring those who have money while turning against poor people who forms the majority of the country’s population.
He observed that almost half a dozen of DPP ministers were arrested but no one went to court to obtain an injunction stopping the police from arresting one wondering why the same constitution is favouring MCP corrupt individuals?

” There’s selective application of justice in Malawi, the court granting injunctions to thieves that the police must not arrest them, where is our country going?” Questioned Kamphangala.
He said it is sad that the Malawi Law Commission, Malawi Law Society and other law institutions are quiet and watching at injunctions being granted in defense of thieves from being arrested.
The MCP diehard has proposed to the government to abolish the current constitution which is protecting thieves for a new one which will be framed by poor people in Malawi so that no one should be above the law.
Kamphangala said as the Malawi Constitution stands today, MCP President Dr. Lazarus Chakwera, Richard Chimwendo Banda, Colleen Zamba, Simplex Chithyola Banda, MCP panga wielding thugs, and others, are above the law and the law cannot arrest them.
He has finally urged poor people in Malawi to stand up regardless of their political party affiliations, to call for a Constitutional conference in Malawi to redraft the Malawi Constitution observing that as signs are on the wall, Malawi is being run with a Constitution favouring those who have money to buy for themselves justice and freedom.
