The Commercial Division of the Hiigh Court in Lilongwe is on October 3 2022 expected to deliver a ruling on two applications by Gam Fuels Limited on the legal tussle surrounding the controversial sale of its filling station at Kanengo in Lilongwe.
First, Gam Fuels Limited lawyer, Jimion Nyanda wants the court to remove Realsim as an interested party to the case. This is a company which bought the filling station from Sheriffs at K610 million. It is chaired by Bishop Abraham Simama.
“We feel that issues that are in contention in the case can be decided without hearing from Realisim. The execution of the processes were initiated by the claimant, Masters Borehole Company, and not Realisim,” argued Nyanda.
Nyanda also wants Masters Borehole Drilling Company, owned by businessman, Alfred Gangata to produce documents that will assist in the assessment of claimed damages.
Gangata is claiming K747 million for allegedly losing business after the filling station’s owner, Gelesoni Mkweza confiscated Gangata’s drilling compressor keys to push for payment of K1.5 million debt.
After hearing the two applications on Tuesday, Registrar of the Court Anthony Kapaswiche reserved his ruling until the third of next month
Lawyers for Realsim Gift Katundu and Masters Borehole Drilling Company Stanley Chirwa respectively declined to comment on the matter.
