High Court in Blantyre Temporarily Halts Kalibu Academy’s Application Against Kachanga Mosque Azan

The High Court in Blantyre has temporarily suspended proceedings in a case involving Kalibu Academy and the Kachanga Mosque in Chileka. The school, represented by lawyer Aski Pasola, had sought an injunction to stop the mosque from broadcasting the Azan, the Islamic call to prayer, citing concerns over noise disruption.

Kalibu Academy Raises Concerns Over Noise

In a formal court filing, Kalibu Academy argued that the Azan generates excessive noise that interferes with classroom learning and disrupts other religious activities in the area. The school requested the court to issue an immediate order preventing the mosque from conducting the prayer call until the matter is resolved.

Mosque Requests Time to Respond

However, Morris Matola M’baya, representing the Kachanga Mosque, requested a temporary halt to the proceedings. He informed Justice Mike Tembo that the mosque needed time to properly understand the claims made by the school before responding.

“Our side wishes to first review and understand the details of the case thoroughly to provide a well-informed response to the school’s demands,” said M’baya.

Court Grants Seven-Day Pause

The High Court has granted a seven-day pause, allowing both parties to prepare adequately before the application resumes. This pause ensures that the case will be addressed comprehensively and fairly.

Balancing Religious Practices and Community Concerns

This case highlights the ongoing challenge of balancing religious freedom with community concerns. While the Azan is a vital part of Islamic worship, local communities often raise issues about noise and its impact on daily life. The court’s decision in this matter may set a precedent for similar cases in Malawi.
