Court Dismissed an application by ACB To Dismiss an appeal by Uladi Mussa

Justice of Appeal Lovemore Chikopa has dismissed an application by ACB to summarily dismiss an appeal by Uladi Mussa- former Minister of Home Affairs and two others.

Mussa,former Central Region Immigration Officer David Kwanjana and business person Peter Katasya were convicted and sentenced on their involvement in the issuing of citizenships to foreign nationals.

However the three filed an appeal, asking the court to overturn their conviction and sentence.

But ACB asked the court to summarily dismiss the appeal because among others, the convicts failed to specify the grounds of appeal.

But in his ruling Justice Chikopa has dismissed the application by ACB saying the court exercises it’s power to dismiss an appeal at its own behest not based on application.

“The court has not in the instant case, determined that this is a hopeless case or one with no prospect of success.”

Meanwhile , the court will on Wednesday 23rd March 2022 hear an application for bail pending appeal by Mussa
