A Malawi Congress Party (MCP) diehard of Mvera in Dowa district Mr. Rodgers Kamphangala, has called on the country’s judges to interpret the Republican Constitution following the clocking of President Dr. Lazarus Chakwera to 5 full years in office on the 23rd June, 2025.
Kamphangala has reminded Malawians that on the 23rd June, 2020 Malawians voted for President Chakwera into office saying as per the Constitutional requirement, he was supposed to serve for 4 years in office since one year was already served by former President Professor Arthur Peter Mutharika from May, 2019 to May, 2020.
He said legally, Malawi could have elected a new President on the 21st May, 2024 but because of greed by the country’s politicians taking advantage over quietness of the citizens, Members of Parliament (MPs) without consulting the people they serve, changed electoral laws that the elections to be held on the 16th September, 2025.
The MCP diehard said while President Chakwera has clocked full 5 years in office, MPs and councilors have clocked 6 years in office meaning that the country is not respecting the Republican Constitution or that the country has no Constitution.
He said in a country where the Republican Constitution is respected and is above all else, the change of the electoral laws particularly on the date of holding the General Elections would have been decided through a National Referendum or opinion poll.
Kamphangala said in Malawi, Members of Parliament vested power in themselves changed the voting date from 21st May to 16th September, 2025 for reasons best explained by themselves and the judges who are just watching this to happen in their eyes.
He said what appeared before will re-appear saying the issue of the change of voting day to 16th September, 2025 without consulting the citizens might look very simple today, tomorrow the same law will make one to be a dictator in a country of democracy.
Kamphangala said in his own understanding of the Republican Constitution where there is a clause that Malawi shall have elections in every after 5 years, Malawi has an illegal President, illegal Parliament and illegal councilors, all occupying their offices illegally from the 21st May, 2024.
“If we are to go by our Constitution, all office bearers are illegal, Malawi is a country run without laws and if there are laws, are to punish the poor people,” he said.
He said from the 24th June, 2025 President Chakwera, MPs and councilors will be extending their stay in office questioning the Judges to come clear that is President Chakwera legally mandated to oversee the 16th September, 2025 elections?
Kamphangala said the Americans are using the same law adopted in 1863 why Malawi is failing to live up to its adopted laws of 1994 claiming that legally, from the 24th June, 2025 there could have been an Interim Government or Caretaker government and this one could oversee the General Elections on the 16th September, 2025.
He has assured Malawians that he doesn’t have personal grudges with anybody in Malawi but he is a law abiding citizen appealing to the judges to interpret the constitution on whether indeed the Constitution is supreme or note.
Kamphangala has finally appealed to church organizations, church leaders and Civil Society Organizations (CSOS) to look critically to the country’s Constitution if it is being respected or note, and what to do as a country.
