AG to challenge Chimwendo Banda’s judicial review case

Malawi Congress Party (MCP) Secretary General Richard Chimwendo Banda’s celebrations that he is being protected by the High Court of Malawi order restraining the police from further arresting him judicial review, is to be challenged in court.

The Inspector General of Police, and the Director of Public Prosecutions (DPP) have appointed Attorney General Frank Mbeta to represent the State in judicial reviews set on 23rd January, 2026 for Chimwendo Banda and 11 MCP panga wielding thugs who were also released with the same order of restraining the police from arresting them.

The court order of stopping police from further arresting Chimwendo Banda and 11 MCP panga wielding thugs sent shocking waves amongst Malawians doubting the independence of the Judicial Service with other Malawians describing the Malawi courts as rotten, corrupt, and compromise.

For the first time in the history of the country, Malawians were also shocked hearing an injunction which was granted to MDF generals and Police Commissioners stopping government from redeploying them to civilian institutions.

Richard Chimwendo Banda’s attempted murder case on Frank Chiwanda has attracted attention from many Malawians and the world that two High Court Judges Mzonde Mvula and Kenyatta Nyirenda released him unconditionally from Maula prison where he was remanded.

In all the court rulings, both the Attorney General and Director of Public Prosecutions were seen to be quiet beside calls from millions of Malawians demanding government to lift the injunctions and map the way forward of the cases in court.

Malawians have been questioning if the country has an Attorney General and the Director of Public Prosecutions (DPP) and with the decision reached to challenge the court review cases, Malawians are now feeling a sigh of relief that justice is now set to be seen.

A concerned citizen of Malawi residing in Area 51- Lilongwe Mrs. Elizabeth Kaliza Banda, has asked the new government of the Democratic Progressive Party (DPP) through the Judicial Service Commission to transfer Magistrates and Judges who are being seen to be working for MCP.

Kaliza has warned government that failure to transfer these judges and Magistrates, it should expect embarrassment court rulings against it alleging that these are the very same Judges who fought tooth and nail to make sure that the DPP die a natural death with injunctions against injunctions in the five years of President Chakwera and his MCP led government.

“For 5 years of President Chakwera and the MCP, two High Court Judges Simeon Mdeza and Kenyatta Nyirenda made the DPP to sweat in court making it not winning any case,” she alleged.
